The Antisocial Behaviour Act 2003 was introduced to tackle persistent nuisance and disruptive behaviour in England and Wales. It gave local authorities, police and social landlords stronger powers to deal with problem behaviour affecting communities.

Most of this legislation has now been replaced by the Anti-Social Behaviour, Crime and Policing Act 2014, which took over as the main framework for dealing with antisocial behaviour. However, understanding the 2003 Act helps explain how the current system developed. You may still see references to it in older tenancy agreements, local authority documents, or cases that began before the 2014 Act came into force.

Key powers under the Act

The 2003 Act introduced measures targeting specific problems that had proven difficult to address under existing laws. These included drug-related nuisance from residential properties, youth antisocial behaviour, and groups causing persistent trouble in public spaces.

Closure orders for problem premises: Police gained the power to apply to a Magistrates Court to close residential properties linked to serious problems. This covered two main situations:

  • Properties connected with the use, production or supply of Class A drugs, where there had been serious nuisance or disorder affecting the public in the previous three months
  • Properties associated with significant and persistent disorder, or persistent serious nuisance to members of the public in the previous three months

Once a closure order was in place, entering the premises became a criminal offence. Those who breached a closure order could face up to six months in prison or a fine. These orders provided quick relief for neighbours living near properties causing ongoing disruption. The 2014 Act has since replaced these closure powers with updated provisions under Part 4 of that legislation.

Extended powers for social landlords: While registered social landlords such as housing associations already had some ability to seek injunctions under earlier legislation, the 2003 Act expanded these powers. It made it easier for them to take direct action against individuals causing antisocial behaviour without relying solely on the police or local council to intervene first.

Parenting contracts and orders: The Act introduced measures to address antisocial behaviour by young people through their parents. This included formal written agreements between parents and local authorities, and where these proved insufficient, court-ordered parenting programmes designed to improve supervision and control of children involved in problem behaviour.

Community safety orders: The 2003 Act also brought in provisions allowing courts to impose requirements on individuals whose behaviour was causing harassment, alarm or distress. These orders could restrict where someone could go or who they could associate with.

Dispersal powers: Police were given authority to disperse groups in designated areas where antisocial behaviour had been a persistent problem. Officers could move people on and return under-16s to their homes. These powers have since been replaced by the broader dispersal powers in Part 3 of the 2014 Act.

How the 2014 Act changed things

The Anti-Social Behaviour, Crime and Policing Act 2014 replaced and simplified the various tools that had built up over the years, including most provisions from the 2003 Act. The aim was to create a more straightforward system that was easier for authorities to use and for the public to understand.

The 2014 Act introduced:

  • Civil injunctions to replace ASBOs and other court orders
  • Community Protection Notices for ongoing problems affecting a local area
  • Public Spaces Protection Orders to restrict activities in specific locations
  • Updated closure powers that built on and refined the 2003 provisions

What this means if you have a problem neighbour

If you are experiencing antisocial behaviour from a neighbour, the specific legislation matters less than knowing who can help and what practical steps to take. Your first point of contact will usually be:

  • Your local council, which has a duty to investigate antisocial behaviour complaints
  • Your landlord, if you rent from a housing association or council
  • The police, if the behaviour involves criminal activity or you feel unsafe

Keep a written record of incidents, including dates, times and what happened. This evidence will support any formal complaint you make.

Be aware that councils and housing associations have limited resources and may not be able to resolve every situation. For persistent problems where formal action has not worked, consider community mediation services or seeking legal advice about your options.

Many councils have dedicated antisocial behaviour teams, and housing associations have their own complaints procedures. Contact details are usually available on your local council website or your landlord's website.

@Dee Your neighbour is wrong. Parking on a footway (pavement) that obstructs pedestrians is an offence, and police can issue fines or have vehicles removed regardless of whether they're taxed and registered. Report it to your local council's parking enforcement and to the police on 101, and log every incident of the gestures and abuse as antisocial behaviour. Keep a diary with dates and times, as you'll need that evidence if you want the council or police to take formal action.

Our neighbour owns 5 vehicles and two trailers. At any given time there are at least two vehicles and a trailer parked on the footpath, obstructing pedestrian traffic. The other trailer and cars are parked on the road outside his residence. He claims that as the vehicles are registered, he has permission to park them on the footpath. Could you please advise if this is correct. He is a very aggressive and abusive person and not approachable. He constantly makes extremely rude gestures and mouths foul language at us constantly.

My friend has neighbours who have been waking them up in the early hours of the morning for years (about 8 or 9 years). They suddenly scream abuse at each other and shout things like 'ow ow ow' and you've wet the bed! so loud that it wakes them up. They have loud distressing arguments at least three times a week that they can clearly hear.

They were so worried about them that a few years ago they knocked on their door and asked if they were ok. They both said they were. The police have been called numerous times (by themselves!)and we think they are drinking a lot as often the police appear but they don't answer the door. There have been ambulances called out in the night, then they don't answer the door, and since they had their child, social services have been called more than once. The issue is that nothing seems to be done and they can still hear the verbal abuse happening, now involving the daughter who is about 6. The mum tells her that daddy is useless, needs to get a job, to get out of the way amongst other things. We believe the mum is the aggressor. My friend's own daughters have grown up hearing this through the walls and it's very distressing indeed. They've told the neighbours they can hear it many times, banged on their door, shouted through the wall etc. But it just carries on. They are very worried about the little girl's well-being but don't believe she is being physically abused, just verbally.

The mum has had a couple of injuries that we know about including a broken pelvis currently, though we don't believe it's her husband. We think she is drunk and hurts herself. The daughter has been heard begging them to stop. This week my friend told the dad it's so distressing, they've had enough and need it to stop but he just shrugs and says it's just drama, that it's not physical. The worst thing is constantly waiting to hear the next argument as it's very distressing for them to live next door to. Is there anything else they can do to get help and make it stop? My friend is at the end of her tether and the police and social services don't seem to be worried enough about them to do anything other than occasionally visit.

Where can a man and his wife have learned to influence people. If not in prison or a mental health institutition.

The government may be planning a lock down but here adult men (and their offspring and their wives and parents) have voluntarily not left their yard, front porch. Have not gone further than a few yards /a few steps from their front door, voluntarily because of me.

They watch me and make noise around the clock. Deny their offspring from using parks, fields, forests, just hang around next to my home. Hang around outside.

Usually no-one here anuwhere else uses their gardens. They are empty everywhere else because they are small and people can be seen and people just usually leave their home to do sport or to have some other hobby. In towns. Well even in tve country side i have never seenadult men just hang around. Usually gardens are for the women to use. I have sometimes sen women but never men hanging around at hlne anywhere else.

Here dozens of men hang around not go anywhere like ride a bike to a field take their own famiky, kids to hobbies. They are addicted to me, a strange woman. Dont take their own offspring to hobbies even, they ask other peoole to do that.

They know you can here every move someone makes out because just me walnkng in my garden makes them open blinds and come stare in the window so they choose to yell even teens adult men offspring just hang around here. 3 men stop 3 men start it.

Yes believe me. I am not megalomaniac. These adult men hang around like tgey are prisonersbecause of me, a married woman.

Here adult men hang around on my sake. Dont see anything wierd in that. Hate campaign, noise canpaign. They feel menly like they are defending their rights to use their yards, feel community spirit, hate towards me and watch me, always eyes on my windows, hang around, voluntarily for a decade and longer been just hanging around, not leaving the vicinity of their front porch, all the time outside using appliences and making noise.

I live on a housing estate , my family keep themselves to themselves and we all mind our own business, and only speak to our neighbours, my son has just started his own business and has a van , it has been egged and so has the side of my house , where do I stand , I have reported it to the police.

Is it just here that families are different or have families changed in a few decades. Like in 1970's all parents were considerate of others.
maybe they had low self-esteem but they didn't let their kid bother anybody but were always like very court snd ordered their children, about, very considerate of neighbors and anxious to see that they or their kids didnt make noiae. They ordered them to be quiet dont go there hanging about... they just had this look ar their kid and it was enough at a birthdsy party so he would behave and not have any more cake . Or wouldn't be a nuisance to anybody. No parent i knew back then thought that their kid was a gift from god and other people would enjoy his being noisy. Or around even. I liked these considerate parents who didnt think they can do anything just because they have reproduced. I liked them being realistic and low self esteem realizing their kid isnt allowed to make anybodys life miserable. That was out of the question. They , kids knew their place and that was not to bully anyone with noise

Now parents themselves yell, let their kids gather anywhere not just parks and have no limit to what they allow themselves their visitors their families that visit or their kids can make any amount of noise but othwr people dont matter. It is called self esteem? Or selfish?

Can bullying be when one neighbor spread bad rumours to other neighbors about you and try to get other neighbour to side with them and they will call officer on you, even when you didn't do anything that will cause disturbance. we are only asian race different from the rest of the neighbors who are all middle eastern on the street. I notice they only to seem like they pick on us mostly cause we will not do anything and will keep to ourselves. I did talk to the neighbour one time but that neighbour just yell at me and he will cut me off so none of my words matters. Even, i talk to their guests, it was the same way too but it feel like threatening us. So, i just left as that and didn't do anything. When we first moved in, the neighbor complain to us, telling us not to park in front of our home cause he can't reverse out of his driveway so we were being considerate and we didn't park there but then he is having their guests park there which I thought we had arrangements about the situation. For 6 years, this neighbour will have their guests park in front of home when there are plenty of space near them. I know it is not my property but should be considerate. During the pandemic,  i notice the neighbor was having a lot of guests more than 10 people visiting their home and will stay for long period of time. They think they own the whole parking spaces on the street. I didn't want to report it and don't want to be bad neighbour. This middle eastern family with guests are purposely provoking us when we wasn't even going to talk to say or do anything

Since April 4th 20 we have put up with a humming noise from upstairs flat it’s leasehold may agent said it’s me Plummer ni got said unit air conditioning Or transmitter low frequency upstairs trying to get rid of us they have been trouble since 2014 harrassment His wife upstairs saying bugger off nobody wants you here the gardener they told him to bugger off and denied it. I asked after breast cancer treatment fr them to make less noise wife said what’s that got to do with it Landlords fr hesr ar useless and insulting. It’s a mess the garden we pay fr that doesn’t get done I’m a landlord since 1970 I understand most there has even been a wasps nest in attic they do nothing

I am a victim of community harassment, community stalking, since 2007. There has not been a day without constant loud noises, mostly screaming yelling their lungs out since gathering here has been going on, families can be evil and my children are playing the price. Also constant construction and sabotage has damaged my house and the ball playing and sabotage my car. My privacy has been broken and my children are victims of evil people. Some like to raise sociopaths, they tell them to go in front of my home and start yelling

The house next door turn the prosperity into small individual 1 bedroom flats one of the bedroom is on my front room wall when I play my radio in the middle of the which I do occasionally she complain I can hardly hear my music in my kitchen my neighbours can not hear my music however this is only because in the rebuilding the cavity walls and was taken out

I would be grateful of any advice? My neighbour who lives above me in a block of flat make constant noise during the day and evening. I can hear them waking, running or jumping around on the floor. At times they can make the light shade swing which is amazing as we have a lump of concrete between us. I once spoke to them about another problem and the response wasn't very friendly so I'm reluctant to speak to them again. I am getting very stressed by this and it feels worse now as I have no respite due to the lockdown.

Can anyone help. We have a neighbour on our street who has 4 cars parked and havent moved fir over 2 yrs. The street is now busy as people are moving in and have cars of there own. This makes it difficult to park in the street as these 4 cars never move but are legal. I have to park in another street which is becoming a nuisance. Does anyone no if there is anything I can do. We have spoken to him as he can put the cars at the back of his home,were he has a further 5. There is also room. He just tells us that they are legal. However is this not been an antisocial neighbour. Please any advise would be helpful. Many thanks

I have planning permission for the erection of a bungalow at the bottom of my garden. my neighbour has sent me a letter saying that my boundary has moved and hedges and bushes have been removed this is not the case I have lived in my property over 20 years I did send a letter to him to confirm what the problem was but I received no response. in addition, he has erected a 15 foot pole with a sign at the top saying do not feed the pigs showing directly into my garden I consider this harassment does anybody have any ideas?

I live in a bungalow owned by a housing association. For 8 years. I am 75 and have 3dogs Dachshunds. I have owned dogs all my life and they are well trained. The neighbour nk Dr has made a conplaint to the Environmental health saying they bark to much, they bark in the garden when the neighbouris by my fence, not always l quickly tell them enough and they stop and are put in. They do not bark at night or early morning ever they are in bed at 9 o'clock in my room which is 2 walls away from the neighbours Living room. I do not go out without them.. They are always with me. However if the weather is hot l cannot take them in the car as l cauld not leave them when l get my shopping he said he has video evidence they bark when l am out. I have no one l can leave them with. No family they are like family. I have spoken to him. He l feel should have spoken to me before he reported me. As we were friendly. Can they take my animals away l do not let them bark they only bark when they hear people at the door. Do not know what to do

My Irish neighbours have gone on holiday the wife is off a traveller family. My home which only has a single brick party wall is really quiet. Ive been woken up regularly at 1am and 3am with banging doors which is blamed on the granddaughter whom wants to live with her mother who is mentally ill. She cant look after herself let alone the child.
These neighbours want my home so they can knock a doorway through so the child can move freely between to houses.Fair market price doesn't even come into it . The local Labour party backs these people in what they do infact those controlling the MP refuse me access where he has told me twice i need an MPs surgery meeting.They say they have spent more money on their refurbishment if they had known they would get my house they where supposed best builders in the locality over 5 years which is questionable with the corruption on the local council.
These people are also in the local freemasonry lodge with whom ive had problems for over 50 years.The female couple on the opposite side are basicaly freemason prostitutes.They did havea red light outside the house when i first came hear around 8 to 9 years ago which they have now removed.Again single brick between party walls.
Out the back i have a man who is aggressive verbally abusive and threatening again he is lodge related. He blames me for his rat problem of which his landlord will not address them since he has to spend money.He also refuses to allow me access across a specfic area which is noted in the deeds of both properties from around 1860.He is also known to be involved as all the niegbours are in the illeagal shoot to kill policy covered up by all UK Chief Constables.His claim to fame is killing a traveller in a fight by cutting a leg artery with a stanley knife. Hes been trying to goud me into a fight over the rat issues . He has also had people on my property that are unauthorized for his own ends. Warwickshire Police wont do anything including refusal to record or logg and crime or incident.Per 4022,4020 Leamington Spa police station. Infact they cant even record a correct name and address for purposes of lost property.

I have been harassed several time because I have an dog who has muscle atrophy due to advanced arthritis.I get most bother from my neighbour in the corner one accords from my their friends and an elderly couple across the road.I told my neighbours on the corner house when I moved in about my dogs condition.Why it limped and why it had small legs.The neighbours across the road had the same breed of dog and it does from cancer bulging it's eyes when it was 16 yrs of age.The neighbour offered one day that he would take the dog up to the vets the next time I was going after he asked me what was wrong with its back end.He shouts across at me all the time Love ,your hurting that dog love bring it over to me and let me heal it up.The guy in the corner shouts give it across the road and he,'ll teen it love.Let him have that dog and he'll walk it in it's teens. He calls outside my front door your stupid love you should feed it cat food and give it steps to climb.Give it succulents. Your not looking after it love.I give it that couple across the road and they'll know how to stretch it's legs out.Give it around there kitchen table love. They'll clip it for you and keep it all fatter around it's legs.My vet has confirmed that the muscle won't return to her hind legs as the joint is to advanced in arthritis and hip replacements aren't an option due to arthritis in her knees. I don't need this attention but the police can't do anything.The women next door calls me a jut even though she knows there doing it.She smokes in her garden with her all day visitors and I can't even sleep in my bedroom because of the smell of cigarette smoke I'm sick of it but I'm not moving.

My friend is being harassed by her two neighbors (they are related). The neighbours have bought their house the other four are council flats. They constantly phone the police about noise. She’s been told “to wear headphones” when putting music on, to “not walk about the flat with shoes on”. The police are constantly at her door. She told me she had been given an ASBO but it was just a warning from the council. The housing officers seem to be taking the neighbors side. I get the impression they are very forthright people, none of the other tenants say there is an issue. It’s affecting her mental health and she’s becoming very very anxious. What can she do, it seems like she’s being bullied by the neighbours who seem to have the ear to the council and police. It seems very unfair and I suspect that processes are not being followed appropriately

We really don't know, but if you're concerned about antisocial behaviour and its effect on your neighbourhood/properties, let the council and police know that as a group, you are not happy.

There is a neeighbour who lives in our block of flats, he has un invited visitors any time of the day/night. They seem to be buying things from him. He does not work and has a reputation in our region for theft from shops. (This is in a local news article) The thing is we cannot get our head round is Many of us have been keeping antisocial records about the comings and goings and that he seems to get arrested on a regular basis But has never been prosecuted or detained he is normally released within a few hours of the arrest. We have since heard that he is a police Informant and has "stitched up" a lot of his Friends?He and his so called 'Visitors' do not have an access key so they damage the security gates and Doors leaving us vunerable ones feeling scared, could this be the reason why he has not been evicted so he is local and easy accsess to the police and they can get all the information they want from him !!!
Hence he never serves time. From a very disgruntled group of Neighbours

This a really difficult situation for you, especially if the neighbours won't communicate at all. Perhaps your environmental health officer would intervene and ask them to attend a mediation session with you? Could you write a note explaining that you do not want to intend to annoy them and explain your lifestyle/patterns of work etc...?

If anyone can offer advice it would be great, as I've found myself in a strange predicament; after my partner and I moved into a property last year, we initially received a couple of complaints regarding music, one in person and once when we received a letter from the Environmental Health team. I explained to the Environmental Health officer who I called in response to the letter, as I had previously explained to the neighbours, we were new to the house and needed to acclimatise to what level of music became a problem, which we did. We have since been conscious of the level of music (which I might add isn't on all the time) as well as keeping the level of conversation down when we have visitors so as not to give the neighbours reason to complain. Now, as part of our tenancy agreement, we are not to smoke in the house, so we smoke on the back doorstep. This leads me to the situation I'm in now; On 3 separate occasions while smoking on the back porch, the male who lives next door has begun shouting abusive language out of the window. The most recent was at 2:00am. Now before I carry on, there is no law saying I can't smoke out the back at any time, plus, me and my friend had just got in from a night out and where having a cigarette and having a general talk about the night, all the while doing this at a reasonable level i.e. no raised voices or screaming laughing as the last thing I want to do is give these neighbours any ammunition to use against me. This happened another time when out the back with my partner (midnight), and once when my Mother was there (11:00pm/Midnight). I recently called the Environmental Health team to explain this and asked if they could add it to their file, which I assumed they had one, but was told there was no complaint filed against me. I can only think that the neighbours prior complaint was deemed not a nuisance (possibly as we had tried to accommodate them) and the case was closed, and they are not happy about this. Me and my partner both work long shifts, with myself alternating between days and nights and while these neighbours are entitled to some peace and quiet, we shouldn't have to tread on eggshells and worry that every little knock or backyard conversation will lead to intervention from the Environmental Health team. To make matters worse, me and my partner have tried approaching them since this began and they literally blank us like we don't exist; how do you resolve a dispute with a neighbour who doesn't acknowledge your existence? As I stated earlier, we both work hard and enjoy our house, but these neighbours come across like they won't be happy until we've either been evicted or leave of our own accord, regardless of any mediation. Anyone?

There is a few over here in Wisconsin, who are threatening people for riding their own home made or updated lawn mowers like an ATV and not just for cutting lawns..., They say they are crazy! I am like ..You got your ideas from tractors, If it was not for them you wouldn’t have an ATV or even a gator or a golf cart, so leave Lawn mower riders alone, it’s not your business!.... and I will start a law court case of breaking constitutional rights!... because threats of damage to me and for the rumors they have are passing around trying to hurt my family and job! “I will also call the Division of Motor Vehicles to pass a law for allowing other riders to NOT threaten those who want something other Then what they specify as that of a golf cart, ATV or gator as the only vehicle for riding on one’s own property or going places, something of a law Like they did for hunters... No harassment!” I have also seen some of these ATV riders threaten Amish people driving horses putting them in danger, I am very worried about this situation with all hope that the harassment stops as they have the right to use their horses with safety to get around also, as we do with any vehicle! This is a anti social activity as they are labeling me for not doing what they think should be done and not letting others use their talents for mechanic's and interesting ideas as a way to enjoy their life on their own property!
And now we have the" Raven which is a Lawn mower/ATV" that does 17 miles an hour and can be used as any other riding machine on the market and hunting is one they do use because it has all the regulative lights and other items on any other machine of it's type! I am trying to ignore these certain people and hoping nothing more will come from this anti social "You do what we do or you are being labeled crazy or stupid!" I call it being mechanically inclined and a money savor friendly project, because ATV s and gators are so darn expensive! ATV riders and "Off Road Lawn mower riders" could be a new way of thinking as one and even make money for their groups( Some already do and work together in a team spirit adventure!) it shouldn't be looked at as crazy...It's individual thinking that works in every way as a vehicle for fun or work! And now with world problems: volcanic activity moving in and earthquakes..... All Off road land vehicles, even Tractors and heavier lawn mowers might some day be the vehicle of choice, even with law enforcement( Some are already in the (USA.. I live in quite a close knitted little community outside of Winchester. Recently two things have come to light:
1. There has been 4 local burglaries/theft all close together in time and location. (House, 2 vans, handbag from car theft).
2. In this time it also came to light that a neighbour over the road in social housing came out of prison and has since returned to using heroin. He has also been seen checking cars in the night with gloves on. He gets a lot of visitors also. His uncle also thinks it could be in his remit as he has a knack for lock breaking.
Now I have no.2 from a couple of people as second hand information. Is it coincidence with the local crimes? Could this just be someone spreading malicious gossip?? I am not happy with the thought of a drug user in my street and in very much a family area. I have seen him walking around both cul de sacs, stopping to look at cars, but not actually committing a crime when I have seen him.
I have no proof he is using drugs and therefore feel it wrong to contact the police however this whole situation has many residents worried, especially the vulnerable.

I recently bought a house 3 months ago the vendor did not declare the noise levels from next door as the reason they were leaving. I have started to hear the rowing and loud music and have called round to let them know. They are in a rented property minebis bought what is the next step if this continues?

Start with your local council's street cleaning department if it's on their/public land. If it's on private property and is causing a nuisance, it's the environmental health department.

A court order might be the only way to resolve this unfortunately. Any prospective buyer should also be looking at the seller's information and deeds themselves rather than listening to the neighbour. Your estate agent should be helping you with this aspect.

Hi,We have an issue with selling our house, we are landlocked, and access is over our neighbours drive. The deeds state clearly that we have unrestricted vehicular and pedestrian access, yet our neighbor not only blocks us in/out by parking in front of our gates (although on her drive) but has taken to telling prospective buyers that there is only pedestrian access. The police aren't interested and it has cost us two house sales. What can we do?

I have noisy neighbours. Everytime I try to sleep she will put tvery on loud. I've reported the situation and couple of times. She will go quite until asbo closes the case then starts up again. I believe she doing drugs when she has friends rounds. I can't prove it. I'm thinking of getting asbo out again. Can someone help.

if you're a tenant everything has to be off by 9. that includes music, washing machine, dishwasher, tv volume (you can still watch tv just without sound.) ect.

Hi there. I would like to know the following. Our living room wall has been gradually getting wet for the last two years. The neighbouring house is owned by a trust. Initially we contacted our insurance company who came to visit and said leak wasn't on our side. we have approached the trust several times, and they subsequent sent surveyors to the adjoining property. results of which are unknown to me. basically all in All, they are not admitting there is a problem on their side, neither are we able to send our own surveyor to that property to investigate what's happening. Our wall is getting wet, property is getting damaged, no one is accepting liability and the trust has offered us a cheque of £350 as gesture of goodwill! What can I do to solve this ' please help and advise.

If you have a genuine reason for this fear (i.e the neighbours have made direct threats to you etc), then you should contact the police.

Hi I really need some advice because it's killing me inside knowing myself and husband and 4 children ages 15 to 8years old are constantly living in fear of 6 of are neighbours I live in a small culdesac an no matter what we do we can't avoid contact with them. I constant worry of violence against us or damage to are housing association home which has happened to us before as all 6 neighbours are friends are constantly looking for trouble and just making my children's life miserable to the point that they can't even play out as there living in fear and I no that the main culprits don't like my youngest son because he has disabilitys even making him. Environmental health will not normally consider "family noise" as an actionable noise nuisance. However, it's worth contacting them for advice on what/whether action can be take you as an individual.

Hi,
We do not know if we have good cause for complaint or not, but our neighbours garden backs on to us and every weekend they invite people round for hours usually until about 11pm. They are all in the garden, their small children are screaming, and they never quieten them. They stay in the garden chatting and laughing loudly. They have a bouncy castle for the children which requires an electric pump to stay inflated, and now this weekend have put a hot tub in. They have their friends out there now, drinking and screaming with laughter. Last year we asked them politely if they could make less noise, but their answer was that we are disrespecting their children if they cannot play in their own garden. We have 4 grandchildren and certainly know that our daughters would not allow that level of noise. Are we being unreasonable? This is really stressing us out, and we hardly go in our own garden.

It is mid July 32° outside and we've got to keep our windows closed so we don't get smoked out. Where do I stand legally ?

I live in a council property, from out side looks like normal house, but council turned in to two flats, I'm on ground floor but unfortunately my bed room windows are in up stairs neighbours garden, she moved in as single perant with 2 kids, 2 weeks later she move her very aggressive and nasty boyfriend in, for 7 years now I have savearly suffered from these neighbours, I've been attacked by 4 male friends of there's, been spat at, racially abused, he threatened with a knife while he was up there, had food on table out side back door he spat on it, I've been urinated on for hin up stairs l,3 times he has driven his car at me, also for 7 years they had been having very loud party's out side my bed room windows, they have planted there gazebo right out side my bed room windows,he's been caught trying to look at me through windows, recently he was caught looking at my son girl friend she was sleeping in her underwear because it been so hot, lots of times I've caught him filming me, numerous times I've called police they do Nothing, when I said about him perving at my sons girlfriend, police said he is in his own home, he told police that day he don't live there, bearing in mind this man is not a council tenant, she claims benefits,so that fraud for a start when he threatened me with knife, police he is in his dwelling that can't do anything, been on to housing officers pippa browse and raj kelsey, poppa browse was friends with them so that why she never helped me, she gave 3 notices of seeking possession, one was because I had a chicken and owed 11.59p in rent arrears, neighbours up stairs said your being evicted and we are moving in your flat, any way still here, pippa browse was moved she was totally useless at her job, she bullied and threatened me alot told council they all stick up for each other,now I have raj kelsey he said I have to make statement to duty officer about boy friend from upstairs perving at my sons girlfriend, he said he will visit with council police officer and tell him he did nothing I heard from him 2 weeks later and he turned it around and said my son girlfriend has to be registered at my address, she don't live here she comes acasionly with my grand son, raj kelsay,s exact words to me was up stairs can had who she likes up there, how is this fair, he is bias towards me, she shouldn't be allowed she should be sacked, how can council top bosses stand by and let this unacceptable behavior happened the council have a duty of care, last weekend they had another one of there very loud party's, speakers out side my bedroom windows call wardens they said it's a nice day for a party all other neighbours have had enough of them wardens left still music blearing, they did nothing, it states in tenancy agreement, no loud speakers in garden, no annoying neighbours, they have broken so many rules, the council,police,wardens,environmental health, all do nothing, I'm frightened for my safty,I can't open my windows or curt

My neighbour who owns his property has lived next door on his own for the last 12 years. He has always been very quiet keeping himself to himself. Over the last few months he has taken in a number of lodgers. Every Sat and sun, weather permitting they take their music system into the garden, turn up the bass and blast out music for hours on end. Most evenings they have their music blaring from inside the house too. It always goes off by 11pm ( which is a blessing) I don't want to be a party pooper because my son occasionally plays his music but never past 8pm. Just wandered if I had good cause to ask them to turn it down, even if they turned the bass down that would be an improvement.

If you feel comfortable enough to ask him to turn it down a little then do so. Otherwise call your environmental health officer and ask for advice. It may be that your neighbour doesn't realise the volume is so high - it could simply be a security measure.

Things have been strained with my neighbour after I rejected his drunken, rather pushy advances, he was very persistent and I had to push him off several times. It was upsetting and I have since avoided him completely, I think we've said hello a couple of times in passing but that's all.
The last few weeks he has started switching his radio on as he leaves for work. If he's had it on prior to leaving for work he just turns it up and then leaves. The sound is travelling down the chimney breast and I can't escape it wherever I am in the small house. I have taken to wearing ear plugs all day.
It's not hugely loud but loud enough that I can hear it over my TV.
I'm finding it stressful, I have fibromyalgia and the stress is making me feel ill.
I just want to move but can't right now.

I am Scottish, but live in England. After finding out my partner of 6yrs was cheating on me she made me homeless (no common law in England left me without recourse).
I was eventually offered- and took- a flat (in the right area) that allowed me to keep my job.
Nobody told me the local paedophile lives above me! No mention of this was ever made!
He is a repeat offender and is well known by the police and the local community.
He sits in the 'communial area' (although nobody else uses it) at my doorway, drinking all day (in a state of undress) right outside my door/ a neighbours bathroom window (The toddler who did live there was clearly heard splashing about) and within arms reach of childrens clothing -including underwear- on the line.
He urinates in the 'communal area' for clothes to hang- its quicker for him that going upstairs to his flat) so nobody uses that area anymore. I have a tumble dryer now.
He dumps his rubbish bags outside my flat window- refusing to use the large skip area provided by the council.
I can hear him from the moment I wake till he drinks himself to sleep.
Recently I returned from shopping to find 'Pedo C**t' spray painted on the gable end of my building.
Now my problem: I am on Life License. The last pervert I tried to kill got me 3 years in prison. I have been diagnosed with PTSD and take medication to help me cope.
My life is dominated by a paedophile who appears to be PROTECTED by the system. Not only is he protected, but Luminus Housing actually provide a string of tenants WITH YOUNG CHILDREN to live in this small block of flats!!
I have no children, but my friends and family do - and I cant have them visit me because of a fat, old, half-drunk, loud, semi dressed pervert who acts like lord of the manor!
I complained to police- they said its a council matter. I complained to the council and was told - 'my opinion' of my neighbour isnt grounds for a move!?!
NB Even in prison, paedos are kept away from general population, but on Civvy Street they are housed with violent offenders (me) and people with children??????? I doesnt take a rocket scientist to imagine the ending...
A housing officer avoided a meeting with me, choosing instead to post a pamphlet through my letterbox on 'How to deal with Stress' !
My GP is onside, but unable to help. As were the police. As is everyone I tell! WTF are Luminus putting NORMAL people in with a PAEDO?????
Apparently, landlords (Luminus in my case) have no duty to inform tenants of 'dangerous' neighbours. How can THAT be ?
Surely: 'Close to schools and shops, handy for GP surgery and pharmacy, close to a bus stop, and oh yeah- your underneath a kiddy-fiddler who suffers random violent attacks and the building get vandalized regularly.' -THATS what tenants need to know!

I have a small shed where I have a wood burner my flue is 11 foot above ground. I live in a residential smoke free zone. Can I legally burn defra approved smokeless Heat logs? My neighbour is a nasty guy we have reported him for antisocial behaviour and now he is complaining about smoke???? Can I still use my wood burner using fuel above?

I am a council tenant in a second top floor flat and have lived here for 20 years. Never had a problem until three months ago with the new neighbours moved in the flat below,
straight away the noise levels rose at all times of day with the constant smell of what I have been told is cannabis!!!!!! the communal stairs are always full of the smoke.
This has been reported to both Milton Keynes council and police but no action seems to go any further than a short visit to the address.
I am on the homewapper site to get out but no one will swap when they see what they will have to put up with.
I am at the end of my tether and feel let down by the people who should be sorting this out.
What else can I do????

To all you law abiding tenants who don't cause any trouble to neighbours who own their properties here are the facts
1) expect no help from the police they will wash their hands of any situation and tell you "it's a civil matter" and that includes community support police.
2) don't expect or trust your landlord to protect you they just want to appease the home owning neighbours no matter how unfounded or unreasonable their lies become. Carry on paying the rent though!
3) when you find that as a tenant the laws of this country are geared up to owners of property only they have every right to harrass you but if you put a foot wrong watch the full weight of the law will come down on you.
4) taking the law in your own hands eventually it can happen as there is no let up in a hate filled campaign and nobody gives a s**t about how you feel you decide to take action then watch the law swing into full action then you lose again then they have their enquiries about how they failed you and what went wrong and how they should have dealt with it "until the next time" that is!
5) local authorities (dogs without teeth) once again only for property owners not for tenants even if they installed listening equipment to the problem neighbours the outcome will be non conclusive.
6) good and kind hearted tenants need to have powers to sue the unreasonable pus filled neighbours and the landlord for damages to their quality of life the stress and anger that it produces and the total frustration of not being heard by any court of law because unless you're rich or a friend of the judge you won't be heard it's a total mockery of so called justice.

I just want to add to the moderator's response to amf's post.
first of I agree that the noise problem is made worse by the way the place is designed.
but what I think adds to the torment and frustration felt by those who suffer day after day,
Is the thought that the designers and the local authorities are likely to be aware of problems caused by their ideas,
and instead of doing their utmost to rectify these problems
they just seem to ignore them and carry on building these places which cause the people that live in them no end of frustration and torment.
how many times have people heard council official's saying "we are listening"
only to shatter that by allowing more havens of torment to be built?
Ive heard it said again and again by Councillors in my local Borough,
but what they don't want to accept is that if they say they are listening to the cries and concerns of the public,
they ought to show it by carefully designing places,
and try not to repeat mistakes of the past.
but instead they keep getting it wrong
and then they express surprise when a poll shows that their borough has the 3rd most unhappiest people in London.
those people may have jobs, clothes, food, all the basics
and yet if the place where they live is a regular source of torment
then it becomes difficult to feel happy and content.
the impression I get is that local authorities seem to think that "something is better than nothing" and so they allow another haven of torment to be built
which may may provide a place to sleep, eat etc etc.
but again if one is regularly disturbed by noise which is made worse by poor design
then the people living in them will always battle against feelings of frustration and torment.
I Think it is high time for the authorities to admit that they "haven't being listening enough."
but that would mean rebuilding which costs money
and money is being held back due to more incompetence at the heart of government
so the authorities will be reluctant to "start again"
and so people are left...literally abandoned in a stressful frustrating position.
OK the situation isn't as bad as other countries around the world,
but that shouldn't mean the authorities should be complacent.
we are all obliged for example to pay the council Tax
and if we refuse
the authorities take action in order to get their way.
well what about the public's needs?
how is it that despite years of crying out we never get our way?
and yet are our demands unreasonable?
is it unreasonable to want to live in a flat or house in which we can enjoy relative peace and security?
the threat of being burgled etc remains
but the people doing those things could help to make people feel secure by stopping stealing.
it is a solvable problem.
and the lack of peace in our homes is also solvable
it just takes a willingness to accept that we can't carry on like this
and be willing to make changes for the sake of peace.

@Amf. There's not a great deal you can do unfortunately. This is a common design problem with certain townhouse/mews/terrace designs. If you feel the neighbours are being excessively noisy then of course acion under the above act may be available to you, but if the council's own monitors did not detect sufficient noise you will not have evidence to do so. There's more information about what constitutes noise pollution, here. Moving the stairs to the other side might help but would probably be impractical and not an option to you financially.

I have lived in my property for 11 years - I am in a 3 storey townhouse end terrace. The stairs of the terraces are all on the right hand side of the property so my neighbours stairs are party wall to all my rooms. I can hear constant banging and running up and downstairs for up to 7 hours and into the early hours of the morning! I have installed sound proofing in one room but still my lodger left because of the noise! I am in financial trouble as I can't get anyone to live here. The council installed monitors but said the noise wasn't loud enough. I'm depressed as can't find a solution

@Ernie. The best advice we can give is to simply ignore them and carry on enjoying your life. There is nothing that you have done that would constitute enough of a "nuisance" to enable them to take any further action. Some people just have no tolerance unfortunately.

My next door neighbour has done nothing but complain about anything I do in my garden, I have tried in the past to be accommodating, they first complained about my chiminea which I removed, they then complained about a large wooden seat which they said they could see from their garden I removed this, they have subsequently complained about my BBQ, (not directly, but making noises like coughing etc, they have even sprayed scented aerosol over my garden, The final straw is when they are now complaining about my wind chimes at the end of my garden, I live in a bungalow, they live in a three storey house with a loft conversion, and can see into everyone elses garden. They have BBQ's I do not complain about them. What can be done please I am desperate

@AT. Is the neighbouring property rented? You could try reporting this to their landlord. If the noise and nuisance behaviour is a regular occurrence and goes on late into the night/morning, then you should contact your environmental health officer who has the power to serve an abatement notice.

Every weekend and sometimes on a Thursday my neighbour below has people round, not very friendly people, and are drinking, taking drugs (namely cocaine) and alot of the time there are children of 4 and 13 in the flat. Myself and 2 children are woken up by music/shouting/laughter etc all hours at night (4am this morning) and havent stopped since, its now 9pm. This is a regular thing and really not sure what to do. If I report it to police Im sure the worst that can happen is a caution for possession, but the type of people there I dont want to risk any retaliation againsts myself or my children. What do I do? I have to live here..

@CarolineL. There's not a great deal you can do about the play equipment but many areas do have regulations (and sometimes covenants in place) that require front gardens to be kept neat and tidy. Speak to a member of your council. If you do this via your councillor, you may have a more effective response.

My elderly neighbour had to go into a nursing home last year and consequently her nephew has taken over as landlord of the property. He is renting it out to a family of six (3 adults and 3 children). It is a small 2-bedroomed bungalow. The problem is that all last summer they were sitting down the driveway/front garden on settees, chairs and tables with rubbish strewn everywhere. The elderly neighbours furniture was turfed out and was left in the front of the driveway in all weathers. The problem is now he has just erected a huge double swing with seesaw and paddling pool in the front garden too. Can we do something about this as it looks a complete eyesore.. They never use the back garden at all and can you believe it but there is an actual childrens play area immediately behind the bungalow. Any help please would be greatly received.

@Angel. Make a note of the times and duration of every bonfire. This could constitute a smoke nuisance under the Environmental Protection Act. Some council areas also have bylaws relating to bonfires, so you might want to check that out too. Take a look at this article for more information on bonfires.

My neighbours live in a close to our left and their garden ends at my house. One is having bonfires up to twice a week burning garden waste (his garden is more of an allotment) but the site is less than 10 feet from my house! My patio is covered in ash, I constantly have to run and get my washing in and close all the windows and we are unable to use our garden. He had one today around 1pm and we spent the afternoon inside because of it. I have asked him nicely to relocate it or stop it and was met with abuse and ridicule. I therefore reported to council environmental health who have basically said there are no laws governing bonfires so there is nothing they can do. Is there really nothing I can do?????

Next door house was sold, new owners renovated 7 days a week, sometimes hammering 12 hours a day for a month. The noise affected our health (confirmed by GP). Then they rented it out, just as bad. Banging on walls, putting notes on cars they don't want parking near their house (which are legally parked), but they themselves park outside other houses , they have 3 vehicles (1 does not move) 2 adults, 2 pre schol kids. Worst of all they smoke as near to our fence and door (3 feet away) as possible despite having a long garden. Asked if they could smoke away from our fence as I have a serious lung condition, she just said no. Then we get their butts in our garden. How their kids sleep with the banging we do not know! This started end of March, so in 5 weeks they have alienated several people. We have considered moving already!!

@Wendy50. It's a shame this person can't be made to understand how miserable she's making you. There's not a great deal you can do if she's simply one of life's 'moaners' but maybe you could ask someone to come and stay with your dog or take it out while you're out yourself? There are lots of voluntary organisations who will help with this, such as the Cinammon Trust.

Hi i am disabled. I have lived at my property for 3 years. As soon as I moved in my neighbour complained to the my council within 2 days of the noise which we couldn't help as we just moved in. And ever since she is complaining all the time about anything. She kept complaining about my 2 dogs saying they where Barking all the time which they don't only if someone was at the door and as soon as they did I told them to stop and they did. The council did visit me and said there was no problem. So she didn't get her way in that. But now she is starting again. One of my dogs have passed away now and she is now complaining that my small dog barks when I go out which I only go out twice a week and not for long my dog has never been on his own before and gets stressed when I leave I know he will get use to it but she won't listen she is not a very nice person. I am worried that she will do something to make me have to give my dog up and he is all I have as I live one my own. I'm very depressed over every thing with her she is making my live very unhappy and she won't leave me alone. And I don't know what to do about her

This is behalf of my sister. She is disabled and next door to her as 11 cats they are pooing all over her gardens. And are always on her window sills she as to keep her windows shut because they try and get in her home she as tryd asking the owners to. Take controls of. There animals but as just got abuse. What can she do if anything she as tryd all the things to keep the cats of her gardens but they just do there business. At the side of them. She's going out of her mind with the smell. Whitch. Is coming from them.

Hi my neighbours are pushing us to the brink just now their grandchildren have been climbing on top of the fence and standing on a brick pillar inbetween staring straight into our living room and then there is the dog noise this is the biggest problem the minute they leave the house the dogs continuously bark there is 3 of them one outside and 2 inside they can b left for a good 3 hrs a day and the noise level is horrendous a neighbour complained via the council last yr about them but nothing has done my 2 eldest children have autism and are refusing to ho outside due to the kids staring and especially the dogs my middle son wears ear defenders in the house when its bad what can I do they are not very approachable people and I'm likely to get a mouthful of abuse if I try to talk to them we are feeling like prisoners in our own home please help

@Sam1. As the article says, your local police are the ones to report this to - it's a community policing issue really.

People hanging around our road in the evening from 10pm until 2:00am in the morning,playing loud music,swearing ,shouting,drinking and smoking. What action do you recommend or who to report to resolve issue?

@endofmytether. Unfortunately if the EHO has investigated and detailed it as 'normal family noise' then there will not be a great deal you can do about it. If the noise continues late into the night or excessively early in the mornings then raise a new complaint.

I have had the same upstairs neighbours for over 2 years. From the moment they moved in they have been a nightmare. All of them are incapable of talking at a normal level,, they just shout. What is worse is that the kids run around the flat, wrestle and bang on my roof every night and every weekend, and are often left on their own and therefore are free to do exactly what they like. I have had an ongoing battle with their letting agency, preceding them, to put down decent carpets with an uderlay. Initially they were very apologetic and I would simply just keep complaining each time they disturbed my peace. They also insisted it wasn't their children making the nose. Things have escalated, mainly because their apologies mean nothing and after putting notes thorugh their door and texting them to tell them what their kids were doing, and it still continuing, I am now having to shout up at them to stop bagning and dropping objects on my ceiling. The council will not do anything because it is considered "normal family noise", and their agency simply say as long as the noise isn't made before 8am and after 9 or 10pm it is considered acceptable. I am at my wits end. I own my flat, they are renting. They have told me they are moving out this summer, and it seems that knowing that they now don't care how much noise they are making. I am feeling increasingly powerless but I don't want to just put up for the next 4 months.

@ginger. Inform the police on a non emergency number (101) . You could also try contacting the school they are from.

Hi, two young boys from nearby, when passing my door, are throwing stones, either at the front window or front door. These youths are in senior school and it's happening on a regular basis. Who do I report the incident to?

@Yo. What kind of objects? For trees and bushes, no not really. For fences it's usually 1 metre at the front of a house.

Hi,

My neighbours regularly smoke cannabis in their garden which drifts into my house through open windows. This I could live with because I would simply close my windows, however they are now starting to have their drug dealers
drop off their drugs at all times of the day.

Their behaviour is escalating with increased bad language, acting aggressively and more frequent drug use.

What action do you recommend I take? without approaching them.
